The issue of liability in cases of International flights, where such flights end in injury or tragedy is no more governed exclusively by domestic law. International conventions such as the Montreal Convention and the Warsaw convention define the rights of passengers, the liability of airlines and the limits of compensation to be awarded across borders. In India, these conventions are implemented through the Carriage by Air Act, 1972, which has become integral in adjudicating disputes involving passenger injury or death in cases of international flights. Issue of liability in cases of domestic air travel is decided on the basis of domestic laws.
